Terms of Service

1. Acceptance of the terms

Welcome to Nutrika. These Terms of Service (the "Terms") constitute a legal agreement between you (the "User") and Inversiones P y P SpA, a company incorporated under the laws of the Republic of Chile (hereinafter "Nutrika", "we") regarding your use of the Nutrika mobile application (the "App").

By downloading, installing, or using Nutrika, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of the service

Nutrika is a mobile nutrition-tracking and training application that lets you:

• Log meals manually, by voice or by photo, analyzed with artificial intelligence.
• Calculate a personalized nutrition plan based on your physical data and goals.
• Track your weight, calories, and macronutrients.
• Train with gym programs and HIIT routines at home, guided by video, and get the session the coach suggests from what you ate that day.
• Save the weight and the sets of every exercise, and pick the days and times you train to get reminders on your phone.
• Generate PDF reports of your progress.
• Receive reminders to log your meals.

Nutrika offers free features and paid Nutrika Pro features (described in Section 4).

3. User account

To use certain features of Nutrika you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality of your password and account access.
• Notify us immediately of any unauthorized use of your account.
• Be responsible for all activity that occurs under your account.
• Be at least 13 years old to create an account.

4. Subscriptions and payments

Nutrika offers a Nutrika Pro subscription with the following options:

• Monthly Plan: billed monthly.
• Annual Plan: billed annually, at a discount versus the monthly plan.

Exact prices are shown in the App before purchase, in the local currency of your App Store account. Payments are processed exclusively through the Apple App Store and are subject to Apple's terms.

The Nutrika Pro subscription unlocks features such as:

• Unlimited AI food photo analysis.
• Gym programs and HIIT routines guided by video, with the weight of every set logged.
• Unlimited PDF report generation.
• Detailed progress charts.
• Smart reminders.

5. Automatic renewal and cancellation

Subscriptions renew automatically at the end of each period (monthly or annual) unless you cancel at least 24 hours before the end of the current period. Your payment method will be charged within the 24 hours before the end of the period.

To cancel your subscription:

1. Open the Settings app on your iPhone.
2. Tap your name at the top.
3. Tap Subscriptions.
4. Select Nutrika.
5. Tap Cancel Subscription.

You can cancel at any time. Cancellation takes effect at the end of the current billing period — you will keep access to Nutrika Pro features until that date.

6. Refunds

All purchases are processed through the Apple App Store. Refund requests must be directed to Apple in accordance with its refund policy. Nutrika does not process refunds directly.

7. Acceptable use

By using Nutrika you agree NOT to:

• Use the App in a way that violates local, national, or international laws.
• Attempt to gain unauthorized access to other users' systems or data.
• Introduce viruses, malware, or malicious code.
• Reverse engineer, decompile, or disassemble the App.
• Use bots, scrapers, or other automated tools to access the App.
• Impersonate another person.
• Use the App for any illegal or unauthorized purpose.

8. Medical and training disclaimer

Always consult a physician, licensed nutritionist, or qualified health professional before:

• Starting any diet or weight-loss program.
• Making significant changes to your diet.
• Following recommendations if you have any medical condition (diabetes, cardiovascular disease, eating disorders, pregnancy, etc.).
• Managing diets for minors.
• Starting any exercise program, especially if you have an injury, a cardiovascular or respiratory condition, are pregnant, are over 65, or have not trained in a long time.

About training

Nutrika's gym and HIIT routines are general programs, not an exercise prescription made for you. Nobody supervises your form: the videos show the movement in a general way and do not replace an in-person trainer.

• Stop if you feel pain, dizziness, shortness of breath or chest discomfort, and seek medical attention.
• Use loads you can control, and do not train with maximum weights without a spotter.
• Warm up first, and adapt or skip any exercise you cannot do safely.
• The workout the coach suggests from what you ate is guidance only: it is never an instruction to compensate for or burn off your food.

Nutrika's calculations are general estimates based on standard formulas (Mifflin-St Jeor, activity factors) and on AI analysis that may contain errors. Do not rely solely on Nutrika to make important decisions about your health.

Nutrika is not responsible for any health consequences arising from use of the App. By using Nutrika, you acknowledge and accept these risks.

9. Intellectual property

Nutrika, its logo, design, code, content, and functionality are the exclusive property of Inversiones P y P SpA and are protected by applicable copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to use Nutrika in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works of the App without our prior written permission.

10. User content

The data you enter into Nutrika (meals, weight, photos, goals, etc.) remains yours. By using the App, you grant us a limited license to process that data for the sole purpose of providing you the service.

You are responsible for the accuracy of the content you enter. We are not responsible for errors in calculations caused by incorrect data.

11. Limitation of liability

To the maximum extent permitted by law, Nutrika and Inversiones P y P SpA will not be liable for direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, revenue, or profits.
• Physical or mental health damages arising from use of the App.
• Errors in nutritional calculations or AI analysis.
• Service interruptions.
• Unauthorized access to your account.

Our total liability will not exceed the amount you have paid to Nutrika in the past 12 months, or USD 50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Nutrika and Inversiones P y P SpA from any claim, demand, or damage (including reasonable legal fees) arising from your use of the App or your violation of these Terms.

13. Termination

We may suspend or terminate your account at any time if you violate these Terms, without prior notice. You may delete your account at any time from the App's settings or by contacting us.

Termination does not entitle you to a refund of subscriptions already paid.

14. Changes to these terms

We may modify these Terms from time to time. If we make material changes, we will notify you through the App or by email at least 15 days in advance. Continued use of Nutrika after the changes constitutes your acceptance of the new Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Chile. Any dispute arising from or in connection with these Terms will be resolved exclusively by the competent courts of Santiago, Chile.
